These Terms of Service ("Terms") govern your use of the website atonwebsites.com and all services provided by ATON Tech LLC ("ATON Websites," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.
1. Services
ATON Websites provides custom web design, search engine optimization (SEO), and related digital services for small businesses. The specific scope, deliverables, and pricing for each project are agreed upon before work begins.
2. Pricing and Payment
- Our standard website plan starts at $175/month after deliverables and design direction are agreed. This covers design, development, hosting, maintenance, and support.
- Custom projects are quoted individually based on scope and complexity.
- The consultation and first design direction are free. Once we agree on the deliverables and design direction, the first monthly payment is due before the build phase begins.
- Future monthly payments are due on the same date each month.
- We accept payment via credit card and bank transfer.
3. Money-Back Guarantee
We stand behind the quality of our work. If we do not deliver the agreed website scope, we will refund your first payment.
4. Website Ownership
- Your content is yours. All text, images, logos, and brand materials you provide remain your property.
- Code and design: The website code and design created by ATON Websites remain our intellectual property while you are on a monthly plan. If you cancel your plan, we can arrange a one-time buyout of the code at fair market value.
- Your domain is yours. We will never hold your domain name hostage. If you leave, your domain stays with you.
5. Your Responsibilities
To deliver the best results, we need your help:
- Provide accurate business information (name, address, phone, services, photos)
- Respond to our questions and review requests in a timely manner
- Ensure you have the legal right to use any content you provide (logos, photos, text)
- Do not use your website for illegal, fraudulent, or harmful purposes
6. Cancellation
- You may cancel your monthly plan at any time by emailing us at hello@atonwebsites.com or calling (470) 298-9288.
- On monthly plans, cancellation before month 24 means the website is taken offline within 30 days unless a code buyout is arranged. After 24 months, you may request a code transfer.
- No cancellation fees. No long-term contracts. No surprises.
7. Limitation of Liability
ATON Websites builds websites to the highest standards of quality and performance. However:
- We do not guarantee specific business outcomes (leads, sales, or revenue) from your website.
- We are not liable for losses resulting from third-party services (hosting outages, email delivery failures, search engine algorithm changes).
- Our total liability for any claim related to our services is limited to the total amount you have paid us in the 12 months preceding the claim.
8. Website Availability
We use Cloudflare to host and deliver your website, providing industry-leading uptime and performance. While we aim for 99.9% uptime, brief interruptions may occur during maintenance or due to circumstances beyond our control.
9. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. We will notify active clients of material changes via email. Continued use of our services after changes constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Georgia, United States. Any disputes will be resolved in the courts of Fulton County, Georgia.
